Your use of the Platform, purchase of products, and use of services available through the Platform are governed by these Terms & Conditions (“Terms of Use”) and the applicable policies published on the Platform, including our Privacy Policy, Shipping Policy, Cancellation & Refund Policy, and Return Policy.

By accessing, browsing, or otherwise using the Platform, or by placing an order through the Platform, you agree to these Terms of Use and the applicable policies.

You are responsible for ensuring that your name, mobile number, email address, billing address, shipping address, and PIN code are correct.

We shall not be responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by you.

2. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, and other information displayed on the Platform are accurate.

Minor variations may occur due to lighting, photography, screen settings, manufacturing variations, packaging changes, or other circumstances.

3. Product Availability

All products are subject to availability.

We reserve the right to limit quantities, discontinue products, or cancel an order where a product becomes unavailable.

If payment has already been received for an order cancelled by us, the applicable refund shall be processed.

4. Orders

By placing an order, you are requesting to purchase the selected product(s).

We may send an order confirmation through email, SMS, WhatsApp, or other available communication methods.

We reserve the right to cancel or refuse an order due to product unavailability, pricing errors, technical issues, suspected fraudulent activity, incorrect information, shipping restrictions, or other legitimate reasons.

You agree to pay the applicable product price and any applicable shipping, COD, tax, or other charges displayed during checkout.

Payments may be processed through third-party payment gateways.

You confirm that you are authorized to use the payment method selected by you.

6. Cash on Delivery

Where COD is available, the customer must pay the applicable amount to the delivery partner at the time of delivery.

Repeated refusal or non-acceptance of COD orders may result in COD being restricted for future orders.

7. Shipping and Delivery

Orders are shipped across India through registered domestic courier companies and other reliable logistics partners.

Orders are generally processed within 1–3 business days from the date of order placement and/or payment confirmation.

After dispatch, delivery generally takes approximately 3–7 business days.

The total estimated delivery time is therefore approximately 4–10 business days from the date of order placement.

Delivery timelines are estimates and may vary because of courier delays, weather conditions, public holidays, transportation disruptions, remote locations, or other circumstances beyond our reasonable control.

The Platform Owner shall not be liable for delays caused by third-party courier companies, postal authorities, or logistics partners.

8. Cancellation, Returns and Refunds

Cancellation requests are generally considered only when made within 24 hours of placing the order, provided the order has not already been processed or shipped.

Returns, replacements, and refunds are subject to our Cancellation & Refund Policy and Return Policy.

9. Intellectual Property

All content on the Platform, including logos, brand names, photographs, graphics, text, product descriptions, website design, layout, videos, and other materials, is owned by, licensed to, or lawfully used by EMPIRE ENTERPRISES / Trendify Kart.

11. Indemnification

You agree to indemnify and hold harmless EMPIRE ENTERPRISES, Trendify Kart, its owner, employees, representatives, agents, and service providers against claims or losses arising from your breach of these Terms, violation of applicable law, misuse of the Platform, or infringement of third-party rights.

12. Force Majeure

Neither party shall be responsible for failure or delay caused by circumstances beyond reasonable control, including natural disasters, severe weather, government restrictions, strikes, transportation disruptions, courier disruptions, technical failures, or other unforeseen events.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

14. Jurisdiction

Subject to applicable law, disputes arising from these Terms or your transactions with Trendify Kart shall be subject to the jurisdiction of the competent courts in Mumbai, Maharashtra, India.
